A Cook County lawsuit alleges a Countryside car dealership failed to inform a customer, who later died in his car, that his vehicle was leaking carbon monoxide when he brought it in for repairs.
An administrator of the deceased man’s estate filed a wrongful death claim against Fishacar Ltd. , which operates as Autobarn Volkswagen of Countryside, the Cook County Recorder reported Friday.
The administrator, Kevin O’Rourke, claims the dealer knew carbon monoxide was being emitted into the passenger compartment of Phillip Osborne’s car when Osborne brought it in for repair work, and failed to warn Osborne of the leak or to stop him from leaving in the car.
Osborne died after leaving the dealership.
O’Rourke is seeking judgment against Fishacar Ltd. in amount of more than $50,000, in addition to court costs. He’s represented by Trapp & Geller in Chicago.
