Class Settlement Proposed for Cablevision Customers

New Jersey Cablevision customers — and former customers — may be in for a bit of financial help with a proposed settlement in federal court of a class action lawsuit concerning alleged overcharges on cable boxes.

The settlement, first announced in December, still requires a final fairness hearing in federal court in Newark in September. 

Under the terms of the settlement, customers in New Jersey, New York and Connecticut who subscribed to Cablevision’s video services and paid a fee to lease the box between April 30, 2004, and March 9, 2016, may be eligible to share in the proceeds of the settlement. 

For current subscribers, the settlement offers credits for services ranging between $50-$140 in value or a one-time bill credit of $20-40.

Former subscribers may be eligible for a one-time cash payment of $20-$40. 

The value of the potential benefits, including temporary free premium channels and months of multi-room DVR services, are based on how long a customer subscribed to Cablevision from 2004 through this year. Customers who already subscribe for DVR service and those premium channels would not be eligible for those benefits, the settlement says. 

Commercial, bulk and municipal accounts are not included among the eligible parties.

The deadline for filing a claim is Sept. 23.

In a statement, Cablevision says it has done nothing wrong. 

“Cablevision denies all of the claims and allegations in the lawsuit and notes that the settlement is subject to final approval of the court,” it said. “We cannot comment further beyond the publicly available filings in the litigation.”

The proposed settlement says that Cablevision would pay the plaintiffs’ legal fees up to $9.5 million. The plaintiffs were represented by Taus, Cebulash & Landau of New York.
