Family of 19-Year-Old Shot by Police Announces Lawsuit and Releases Video

The family of 19-year-old Henry Bennett III who was shot and killed by a officer last year, has filed a federal lawsuit against the Palm Beach Sheriffs Office.

The suit was filed Tuesday,  followed by the release of dashcam footage allegedly showing the Deputy and Bennett III the night of the shooting.

According to the police report, Deputy Andrew Cano pulled over Henry Bennett III and his girlfriend on Avenue D in Belle Glade on January 16, 2016.  Bennett who was driving at the time, pulled over but then took off running.

The department said Deputy Cano ordered Bennett to stop running and get on the ground, however Bennett refused and kept going. Cano claimed that at some point during the short foot chase, Bennett turned toward Cano pointing a gun and that’s when Cano was forced to open fire.

Bennett was shot twice, and later died at the scene.

Witnesses, which include Bennett’s girlfriend, say that the deputy acted with excessive force and Bennett did not have a gun.

Several other members of the community said they offered to give Bennett assistance as he was dying, but deputy Cano told everyone to stay back.

In August, the State Attorney’s Office decided not to file charges in the case because the dash cam video and a gun found at the scene, supported Cano’s account of what happened.

However during a press conference Tuesday, Bennett’s attorney, Jasmine Rand said the footage clearly shows that the object in her clients hand is not a gun.

Rand also claimed that there was no DNA evidence found on the gun at the scene.
