Family of Man Killed by Police Files Lawsuit Against Officers Involved

The family of a Louisville man who was fatally shot by two Metro police officers said those officers were reckless, malicious and grossly negligent.

Body camera video released Monday showed firsthand accounts from the three officers involved in the deadly police shooting on Broadleaf Drive.

The Louisville Metro Police Department has released body camera video of an officer-involved shooting that happened Monday morning.

The family filed a lawsuit Tuesday against the city and the police department.

Metro police Chief Steve Conrad released body camera video of the shooting and said he wanted full transparency from his department.

He also said after watching the video, he still had questions.

Some of those questions have turned into the first step of a legal battle.

On Aug. 28, Metro police responded to a report of a man with a knife at an apartment on Broadleaf Drive.

Within seconds, Darnell Wicker, 57, was fatally shot by two of the responding officers.

A week after the shooting, as police began their investigation, Wicker’s cousin, Natoshia Caldwell, did an exclusive interview with WLKY.

She said not everything had been as it seemed, saying those officers could have handled the situation differently.

In a lawsuit filed Tuesday, the family said the shooting was unjustifiable, intentional, unlawful, unreasonable and excessive.

It claims the officers didn’t announce themselves as law enforcement when they arrived, and they didn’t try to de-escalate the situation.

The lawsuit said within two seconds of Wicker becoming visible, two of the three officers on the scene opened fire.

It also pointed out the only officer who was familiar with the scene and the series of events leading to Wicker coming out is the one who didn’t fire his weapon.

The lawsuit also said after Wicker was shot, the three officers handcuffed him, walked away and allowed him to bleed to death on the ground, and never attempted to render any aid.

The family said Wicker was unable to hear police commands because he is deaf in one ear, and wore a hearing aid in the other.

The lawsuit seeks damages for expenses, pain and suffering and loss of earnings.

WLKY reached out to police for comment about the lawsuit, and they said, “The investigation by the LMPD Public Integrity Unit remains ongoing at this time.”
