The family of a Queens teen fatally shot by cops in November 2009 has decided to drop its lawsuit against the city after questions were raised about the strength of their case, the Daily News has learned.
Kin of Dashawn Vasconcellos filed suit against the city and four officers involved with the Far Rockaway shooting in November 2012.
Vasconcellos, who had a clean record, was with friends in Baywaters Park when he was “unlawfully” approached by cops before they unloaded 11 bullets into him. Cops counter that Vasconcellos pointed a gun at them, prompting — and justifying — the brutal shootout.
Earlier this September, Vasconcellos’ family agreed with the city to dismiss the case with prejudice — meaning they can’t sue again for the same claims.
Their lawyer declined to comment on the decision.
The city Law Department maintains the case was dropped because there wasn’t enough evidence to go forward.
“The parties agreed that the claim that the NYPD failed to properly train its officers in the use of firearms lacked merit and warranted the withdrawal of this suit,” said Daniel Passeser, senior counsel for the Law Department.
