The brother of a man who was strangled while being restrained by staff at the Caddo County Detention Center has filed a federal wrongful death lawsuit alleging jailers used excessive force and failed to provide the man with adequate medical care.

Video of an incident that authorities say led to the death of a Caddo County inmate was released on Monday. The state medical examiner said the inmate died of strangulation.

A multi-county grand jury recommended no charges against detention officers at Caddo County Jail after an inmate died in April.

Law enforcement agencies from all over the state were out in full force at a protest in Caddo County Friday morning after they heard thousands of protesters were going to be gathering at the courthouse.

The lawsuit was filed in U.S. District Court in Oklahoma City by Ancio Robinson just weeks after a grand jury declined to hand up charges in the death of Darius Randell Robinson, 41, who died on April 4 while he was being held at the jail located about 60 miles southwest of Oklahoma City.

An autopsy performed by the Office of the Chief Medical Examiner determined that Robinson died from asphyxiation caused by “manual compression of the neck.” The lawsuit alleges that the force used on Robinson “was excessive, unsafe and disproportionate to any need under the totality of the circumstances.”

“Darius Robinson was wrongfully, unlawfully and unnecessarily choked and strangled to death at the facility,” the lawsuit contends. It says jailers “either did nothing to respond to the emergent medical condition confronting them, or their actions were such a departure from what constitutes an adequate response that their conduct exhibited indifference to the circumstances confronting them.”

The lawsuit seeks millions of dollars in damages from Caddo County Sheriff Lennis Miller, jailers and various county officials. Neither Miller nor District Attorney Jason Hicks immediately returned phone calls seeking comment.

The medical examiner classified Robinson’s death as a homicide, but the grand jury decided against charges. The medical examiner’s report said Robinson became violent and agitated, and that jailers used pepper spray and placed him in a neck hold to subdue him.

The sheriff’s office released video of the incident that shows Robinson appearing to lunge toward jail staff before being tackled to the floor. One staff member appears to restrain Robinson by the neck until he stops resisting, and another staff member handcuffs Robinson while he’s lying restrained on the floor.

Robinson was arrested in Oklahoma City on March 31 on outstanding warrants alleging delinquent child support payments, according to the lawsuit. Medical staff at the Oklahoma County Detention Center found Robinson had a history of substance abuse withdrawal complications and observed the onset of tremors in his arms. They determined that Robinson required medical assessments twice a day.
