Former Penn State Player James Boyd No Longer Lead Plaintiff in Class-Action Concussion Suit Against Penn State: Reports

At Noon on Tuesday, former Penn State safety James Boyd was listed as the lead plaintiff in a concussion/head injury lawsuit filed against his former university, the Big Ten, and the NCAA, according to court documents obtained by the Centre Daily Times. 

Now, a spokesperson for the law firm that filed the claims tells the CDT that is no longer the case.

Boyd withdrew his name as the lead named plaintiff in the case on Tuesday evening, hours after news broke that he and two other onetime Lions, Robert Samuels, a defensive back in the late 1980s, and Eric Ravotti, a linebacker who played for the Lions from 1990-1994, were the named plaintiffs in a class-action suit filed by Chicago-based attorney Jay Edelson that alleged that Penn State was negligent in regards to concussions when the three played at the school.

No other plaintiffs were named. Five different suits were filed in various federal courts around the country on Tuesday. Vanderbilt was the only other school named as a defendant in any of the cases besides Penn State.

“[Boyd] is supportive of the suit, but he is no longer going to be participating as a lead named plaintiff in the suit,” a spokesperson for the Edelson’s firm told the CDT, “adding that Boyd could “still very well join (the suit)” and “could make claims going forward, but his name will not be on the lawsuit going forward.”

Edelson told CBS Sports earlier Tuesday that “The goal of the suits is to get people who are injured financial compensation — something that hasn’t happened as of yet.” His comments come in light of a proposed settlement between the NCAA and current student-athletes that set aside no financial figure for former student-athletes but did grant $70 million for medical screen for former student-athletes.

Boyd could not be reached for comment, and Penn State declined comment, saying that “we have not yet reviewed the complaint,” through a spokesperson on Tuesday afternoon.
