A Nashville chef’s discrimination and retaliation lawsuit against the Gulch restaurant Virago and its parent company has been resolved, according to federal court records.
Jessica Benefield filed the lawsuit in 2013 against restaurant Virago, CEO Chris Hyndman and M Street Entertainment Group. She said that when she raised an array of concerns about a hostile workplace environment for women, including that women were ranked on their attractiveness by Hyndman, she was terminated later that day.
U.S. District Judge Waverly D. Crenshaw Jr. in July dismissed some of Benefield’s claims in a summary judgment ruling favorable to M Street. Those claims included discrimination, hostile work environment and interference with employment.
The judge let Benefield’s retaliation claims stand, and court records show those were resolved in mediation last week.
Jonathan Street, who represented Benefield, said the three retaliation claims that were settled were the most important to Benefield.
“This was about retaliation this entire time,” he said on Tuesday.
The terms of the settlement are not public.
“We’re really positive about the vindication and winning summary judgment on three of the issues that are really quite important to us,” said Jamie Ikerd, chief operating officer of M Street. She said the M Street brands, which includes eight Nashville restaurants and venues mostly in the Gulch area, prioritize a good experience for employees and guests.
“None of the allegations brought forward are compatible with the companies that we hold very dearly as part of our ethos and spirit,” she said.
Benefield is now the chef and partner at Two Ten Jack restaurants in Nashville and Chattanooga. She said she could not comment on the case.
