EAST RUTHERFORD — Giants defensive end Jason Pierre-Paul’s lawsuit against ESPN and reporter Adam Schefter will proceed after a Florida judge declined to dismiss the case, according to a report by The New York Post.

Pierre-Paul is suing Schefter and ESPN for publishing an image of his medical records in July of 2015 when Schefter reported Pierre-Paul’s right index finger had been amputated after his hand was severely damaged in a fireworks accident.

Two hospital workers were also fired for inappropriately accessing Pierre-Paul’s records, one of whom filed a lawsuit against Jackson Health System, which operates Jackson Memorial Hospital in Miami, Fla., where Pierre-Paul was a patient.

According to The Post, the fact the lawsuit was not dismissed after ESPN requested it be thrown out on First Amendment reasons now means the media giant could lose millions. From the report:

The ruling by Miami federal Judge Marcia G. Cooke sets the stage for the state’s second high-profile legal battle in a year between a sports star and a media organization over privacy issues. In March, wrestler Hulk Hogan won a record-breaking $140 million victory over Gawker for publishing his sex video.

“The court correctly ruled that Jason properly stated an invasion-of-privacy claim against ESPN and Adam Schefter, who we allege improperly published Jason’s medical records. Today’s ruling is a recognition of Jason’s right, as a professional athlete, to oppose the publication of his medical records without his consent,” said the football player’s attorney, Mitchell Schuster of Meister Seelig & Fein.

Pierre-Paul argues that while his injury may have been “a matter of legitimate public concern,” the “chart was not.”

Cooke agreed in a ruling she issued from the bench Thursday morning after an hour of arguments.

A legal expert told The Post he expects a quick settlement agreement to follow after the judge’s decision.
