Gina Miller May Consider New Lawsuit Over Great Repeal Bill

Gina Miller, who brought the lawsuit that forced U.K. Prime Minister Theresa May to get parliamentary approval for her Brexit plans, may file another legal challenge — this time over May’s bid to take control over thousands of European Union laws.

The investment manager said Thursday that she would consider going to court to clarify whether or not the government could legally enact the Great Repeal Bill, intended to enshrine EU law into U.K. statute when Brexit takes place. Her initial lawsuit forced May to introduce a bill to gain the authority to trigger Brexit.

She said she was profoundly worried about the use of so-called Henry VIII legislation — which gives more authority to ministers.

“The government is saying it can use these powers but they could well be undemocratic and a power grab,” Miller said in an email. “The complexity of the issue may require the courts to give legal certainty.”

Last year, after the June 23 referendum, Miller filed what was initially considered a long-shot lawsuit demanding Parliament approve May’s plan to invoke Article 50 of the Lisbon Treaty, which starts two years of negotiations to leave the EU. Following a pair of riveting courtroom battles, the U.K. Supreme Court in January backed her arguments.

May triggered Article 50 on Wednesday with a letter to European Council President Donald Tusk after winning parliamentary approval earlier this month.

This isn’t the first time that Miller has pondered a second Brexit lawsuit. Earlier this month, she said would consider a case to ensure Parliament was given a full vote on the final deal for the U.K. to leave the EU.

Earlier Thursday, Miller told BBC Radio 5 Live that she was concerned about how the Great Repeal Bill might affect individuals’ working hours and human rights.
