The Complaint alleges that Belle Tire engaged in a deceptive scheme whereby it misrepresented to Plaintiffs and the Class that in the event one or more (but less than four) tires on their all-wheel drive automobile required replacement, that the standard and manufacturers’ extended warranties required all four tires to be replaced in order to not void the said warranties. Specifically, Belle Tire took affirmative steps to ensure that Plaintiffs and the members of the Class pay for and purchase a complete set of four new tires as well as labor, regardless of how many tires actually required replacement due to damage. This practice targeted all members of the Class and caused them to purchase replacement tires unnecessarily due to Defendants’ misrepresentations. Belle Tire benefited substantially from this deceptive sales practice at the expense of Plaintiffs and the members of the Class.
