A civil lawsuit is accusing two current student athletes at Buchanan High School in Clovis of sexual assault. It’s a case Eyewitness news has been following for a couple of weeks now, after discovering the lawsuit against the two students and their parents.
The 16 year old girl who reported the assault last summer is from out of town. At this point, it appears no disciplinary action has been taken against the students by Clovis Unified, but district officials say they are investigating the claims.
Accusations of sexual assault against two student athletes at Buchanan High School are spelled out inside of a civil lawsuit. Eyewitness News spoke exclusively to the attorney of the 16 year old girl who says she was attacked by both students.
Attorney Steve Estey says, “We’ve alleged that there was a party at one of the defendant’s houses. The parents were not present and there was alcohol.”
According to court documents, the reported crime happened in July of 2015. San Diego attorney Steve Estey says his client was sexually assaulted by the two Clovis students, at one of their homes in Clovis, and suffered physical injuries severe enough to be checked into a hospital. The lawsuit claims she suffered shock and injury to her nervous system and other injuries that may result in permanent disability.
“Without naming names, there was a prosecution in juvenile court and there ultimately was a plea deal.”
Eyewitness News concealed the identities of the defendants because they were minors when the crime was reported. The civil suit also accuses their parents of negligent supervision. Estey says the students were tried in juvenile court, and tells Eyewitness News for the first time in his 20 years of taking on sexual abuse cases, he’s having trouble accessing those files. He says three judges have recused themselves from the case so far, while a fourth denied access to juvenile records.
“I’ve never had a judge deny me access to the file because the victims rights outweigh the defendant’s rights, especially when they plea.”
In another court document, Estey claims one of the students admitted that he and his guests “engaged in underage drinking” at the party where the reported assault happened. According to Clovis Unified, consumption of alcohol and sexual assault are both violations of the district’s code of conduct- which applies to all students involved in extra-curricular activities, including athletics. District officials say they are looking into the case and will investigate any evidence they receive. According to team rosters, both students are still on sports teams at Buchanan High School.
“They’re able to go on with their lives, whereas my client is going to deal with the life long consequences of being sexually assaulted,” says Estey.
The Clovis Police Department confirmed it did take a report regarding a sexual assault on the same date noted in the civil lawsuit, but that file is also confidential.
