Lawsuit Accuses Wise Foods of Underfilling Potato Chip Bags

A pair of consumers are suing the maker of Wise potato chips, accusing the company of underfilling bags.

The proposed class-action lawsuit was filed in a Manhattan federal court Monday night, according to Reuters.

According to the lawsuit, Wise Foods “systematically underfills bags and has left them 58 percent to 75 percent empty.” The consumers who filed suit, Sameline Alce and Desiré Nugent, said leaving the bags only 30 percent underfilled, known in the industry as “nonfunctional slack-fill,” might be justifiable.

The plaintiffs seek damages for consumers in New York and Washington, D.C., in addition to changes in packaging.
