Lawsuit Alleges Planned Parenthood Attack Could Have Been Prevented

A lawsuit that was filed against Planned Parenthood claims the organization should have known an attack like the one that happened in Colorado Springs on Black Friday was likely to happen.

The lawsuit was filed in Denver District Court on Friday and will be delivered to Planned Parenthood tomorrow, according to Kirk McCormick, one of the lawyers representing the plaintiffs.

McCormick did not tell KRDO NewsChannel 13 what damages are being sought in the suit, but did say his clients would like to see Planned Parenthood provide a safer environment at its clinics.

The suit was filed by shooting survivor Samantha Wagner, Ashley Stewart, whose husband died in the shooting, and on behalf of the couple’s child.

Wagner was in a car in the parking lot with Jennifer Markovsky when police said Robert Dear opened fire. Markovsky died and Wagner was shot in the arm.

Named as defendants in the suit are The Planned Parenthood Federation of America and Planned Parenthood of the Rocky Mountains and the company that owns the property the clinic is built on.

The lawsuit argues that given Planned Parenthood’s history of violence and threats directed at its clinics, it should have known an attack like the one in November would happen, and should have had better security and safety warnings in place.

Ke’Arre Stewart, 29, Jennifer Markovsky, 35, and UCCS Police Officer Garrett Swasey died in the attack.

The suspect in the shooting, Robert Dear, is currently undergoing treatment at the Colorado Mental Health Institute at Pueblo after being found incompetent to stand trial.

Robert Dear is charged with 179 counts, including murder, attempted murder, and assault.

His next mental health evaluation hearing is scheduled for August 11.
