Lawsuit Claims Ulta Beauty Resells Used Makeup as New

Two lawsuits have been filed against Ulta Beauty, alleging the retailer cleans up and resells used makeup products as new.

The most recent lawsuit was filed this week by Ulta customer Meghan Devries in Illinois, where the company is based. The suit claims the company “has a routine practice of repackaging and resealing beauty products that have been previously purchased, used, and returned… before returning those used products to its shelves to be purchased by other consumers.”

Less than a month ago, a Los Angeles woman filed a similar lawsuit, reports the Los Angeles Times.

Both suits were inspired by a confessional from someone who claims to be a former Ulta employee on Twitter.

“I feel like makeup lovers should know what’s going on behind closed doors,” tweeted @fatinamxo, before launching into the allegations.

“They would resell EVERYTHING,” which she claimed included makeup, hair and skin products, fragrances and beauty tools. “They even taught us how to clean eyeshadow palettes and let it dry overnight so it can be repackaged and sold the next day.”

The most recent lawsuit quotes others who also claim to be former Ulta employees, corroborating the story shared on Twitter.

“I can assure everyone reading that this 100 percent happens at every Ulta. I work(ed) for Ulta for four years at three different stores and it happened at every one,” the complaint reads. “I remember taking used makeup off the shelves… Managers would follow behind me and put stuff back on the shelves.”

Ulta spokesperson Karen May told ABC News, “Ulta Beauty’s policies and practices do not allow the resale of used, damaged or expired products. As the nation’s largest beauty retailers, we take protecting the integrity of the products we sell very seriously. Based on our review of these allegations, we are confident that our stores uphold our policies and practices. Assertions to the contrary are inconsistent with what we stand for.”

The lawsuit argues Ulta customers “suffered economic damages in the form of monies spent to purchase used beauty products” that they were misled to believe were new. It demands Ulta stop the alleged practice and compensate customers who have unwittingly purchased used products.
