Lawsuit Filed Against Janitor Accused of Raping Student

In February 2017, a grand jury indicted Jessica Elane Galyon, 29, on one count of sexual battery by an authority figure, one count of aggravated statutory rape, and one count of statutory rape by authority figure.

The parents of a Roane County teenager, who they say was raped at school by a janitor, have filed a lawsuit seeking $4.5 million.

The lawsuit was filed Monday against Jessica Elane Galyon, Roane County Schools, and Compass One Services of Tennessee. Compass One is the contractor that employed Galyon.

Galyon also faces criminal charges in connection with the rape allegations.

In February, a grand jury indicted Galyon, 29, on rape charges that included one count of sexual battery by an authority figure, one count of aggravated statutory rape, and one count of statutory rape by an authority figure.

According to the indictment, the alleged rape happened on or around Sept. 13, 2016. The victim is not identified in the indictment, but is described as being at least 13 years old but younger than 18.

The civil lawsuit, filed this week by the victim’s parents, said Galyon was a janitor at Midway High School when she first initiated a “personal relationship” with the victim in August 2016. The suit claims that initially their conversations dealt with mutual interests between them.

According to the lawsuit, Galyon later insisted the victim give her his phone number and that they become friends on Facebook. The Loudon County woman allegedly then began sending flirtatious and sexual messages to the boy.

The multi-million dollar lawsuit claims the victim repeatedly told Galyon that the advances were “unsolicited, unwanted, and unwelcome.”

In early September 2016, the lawsuit says Galyon invited the teen boy to visit her in a hotel room for sex, but he rejected the offer and reiterated “that he did not want any further contact.”

According to the lawsuit, around Sept. 21, 2016, Galyon sent a message to the teen asking him to meet her before school because she needed help moving some supplies. The suit alleges that the boy went in an attempt to confront her about “the persistent and unwanted sexual advances.”

When the victim arrived at the school, Galyon pulled him into a room, began groping him and removed her clothes, the lawsuit said. It added that she then performed non-consensual oral and vaginal sex.

The lawsuit said that the rape happened on the Midway High School campus during school hours. It was the first ever sexual encounter of any kind that the victim had in his life, the lawsuit explained.

Galyon then told the victim he couldn’t tell anyone about the rape or she would lose her job and face other repercussions, the lawsuit stated.

Before and after the incident, the victim’s parents also claim the teen was bullied and teased by fellow students, Midway coaches, and even some faculty members because the persistent harassment by Galyon was well-known.

The lawsuit claims that one Midway coach even told the victim he was jealous of the boy because “he wanted to have sex with Galyon.”

Nearly one month after the rape, a member of the Midway faculty brought the rape to the attention of the school’s administration, according to the suit.

In the months that followed, the victim had to be homeschooled “to escape the relentless taunting and bullying that he received at school” and seek frequent counseling.

Records show the grand jury returned an indictment against Galyon on Feb. 21, 2017.

The victim’s parents say the boy suffered mental, physical, and emotional anguish following the rape and his mental state has diminished severely.  The $4.5 million covers damages and injuries, as well as punitive damages.

The victim’s parents are seeking a jury trial.

Roane County Director of Schools Dr. Leah Watkins confirmed that Galyon is no longer a janitor at Midway High School. Watkins stressed that Galyon worked for a contractor and not the school system.

She added that she can’t comment on pending litigation and has not even seen a copy of the lawsuit yet.
