Arby’s Restaurant Group has agreed to stop using the slogan “Eat Your Bourbon” to market its bourbon bacon sandwiches, according to Matt Jamie, owner of Louisville-based Bourbon Barrel Foods.

Jamie’s company sued the Atlanta-based fast food chain for trademark infringement on Wednesday. A day later, Arby’s said it would stop using the trademark and the two sides have agreed to settle the dispute, Jamie said in an interview.

Arby’s representatives did not return a call for comment Thursday.

Jamie said it’s not the first time his company — which makes gourmet foods like soy sauce aged in bourbon barrels and bourbon-smoked salt and pepper — has taken legal action to defend its trademarks.

“Bourbon is a popular thing right now and everybody is jumping on the bandwagon,” he said.

Bourbon Barrel Foods claims in a lawsuit filed Wednesday in U.S. District Court that the Butchertown business has owned the trademark “Eat Your Bourbon” in connection with its food products since 2012.

The Arby’s campaign began in April and has caused “actual confusion” among customers because of the trademark infringement, according to the lawsuit.

The lawsuit says Arby’s has used the phrase on its website, social media accounts, billboards and other marketing material across the country.

However the slogan was not found on Arby’s website Thursday. The chain is marketing bourbon bacon sandwiches with steak, brisket and turkey.
