Lawyer Offers to Settle Suit Over HOF Game Cancellation

After last Sunday’s Hall of Fame game was cancelled on account of poor field conditions, lawyer Michael Avenatti filed a class-action lawsuit against the NFL seeking compensation for losses incurred by fans that attended the cancelled game. According to NBC Sports, Avenatti sent a letter to NFL Commissioner Roger Goodell on Monday morning with a settlement offer.

Reports say that the lawyer would be willing to settle at a cost of $450 per ticket-holder. Avenatti claims that the settlement represents an undersell of the actual costs incurred by fans who missed out on last Sunday’s game, which he estimates at $700.

In the letter, as reported by NBC’s Pro Football talk, Avenatti writes: “As shown by the above offer, the fans are not seeking ‘jackpot justice’ or a lottery ticket as a result of what happened. They merely want to get a significant amount of their hard-earned money back.” The total cost of settlement for the NFL would be approximately $10 million, which, for a cash cow like the NFL is nothing more than a drop in the vast bucket Goodell oversees.

The settlement offer will remain on the table until just after noon on Friday, August 19th. If the NFL does not accept the offer, Avenatti says that there will be no future offers to settle and that he plans on pursuing the case to its conclusion. Ultimately, the league would likely save money by settling out of court, but the NFL may have concerns that such action would encourage others to come forward to seek money from the league for grievances.
