MotoMart Failed to Provide Handicapped Parking and Other Accommodations, Class Action Suit Alleges

EAST ST. LOUIS — A St. Louis disabled man and a civil rights organization have filed a class action lawsuit against FKG Oil Company d/b/a MotoMart, citing alleged discrimination for lack of accommodations for patrons with disabilities.

DeMaurion Davis and Access Now Inc., individually and on behalf of all others similarly situated, filed a complaint on Feb. 28 in the U.S. District Court for the Southern District of Illinois alleging that the convenience store operator violated Title III of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that as a result of the defendant’s discriminatory practices, he suffered harm for not being able to access the property and purchase its goods, services and accommodation. The plaintiffs hold the defendant responsible because it allegedly failed to provide accessible parking lots and paths of travel and repeatedly denied persons with mobility disability full, equal and safe access to its facility.

The plaintiff requests a trial by jury and seeks an order certifying this as a class action, naming plaintiffs as class representatives and appointing their counsel as class counsel. The plaintiff also seeks award for costs of this action and such other relief the court deems appropriate. The plaintiffs are represented by Matthew H.
