A former administrator who earlier this year sued Wright State University’s research arm has submitted a filing indicating a settlement in the suit may be forthcoming.
Ryan Fendley, former senior advisor to the Wright State provost, filed a motion Sept. 6 in Greene County Common Pleas Court seeking additional time to submit a final entry reflecting a settlement.
Fendley sued Wright State Applied Research Corp. in January seeking $32,583 in damages, as well as attorney fees and interest. He claimed the university breached its contract with him.
The suit says Fendley — who was fired as senior advisor to the provost last year after three months on paid leave — had a consulting contract with the university in addition to his regular job. That contract was terminated on Jan. 11, the suit says.
Fendley was paid $5,000 a month from May to December 2014 to bring the new director of the Wright State Applied Research Corp. up to speed — essentially training his replacement after he was promoted — according to a copy of the contract attached to the lawsuit.
Then in February, Wright State filed a countersuit against Fendley, claiming that he hid his involvement in a potentially criminal temporary work visa scheme when he became a consultant for the university’s research arm.
“(Wright State Applied Research Corp.) would not have entered into the consulting agreement if WSARC had known of Mr. Fendley’s actions involving WSU’s H-1B visa program,” said the February filing, which seeks $55,600 in damages.
Fendley was fired last year from his $169,146 job as assistant to the provost. But this lawsuit concerned an alleged breach of a consulting agreement that he and Wright State Applied Research Corp. reached in May 2014.
This is Fendley’s second lawsuit against the school. A lawsuit filed in December 2015 in the Court of Claims of Ohio alleges that he wasn’t fired for just cause and seeks $249,000 in back pay, including accrued sick and vacation leave.
Another suit against Wright State was filed last week by former consultant, Ron Wine, who is suing the university and Wright State Applied Research Corp. because they “failed to make payments under the compensation agreement” with him and his company, Ron Wine Consulting Group LLC, according to a complaint filed last week in Greene County Common Pleas Court.
Wine alleges breach of contract and seeks $4.53 million that he contends is still owed under a contract he had with the university, plus interest, costs and attorney’s fees.
A Wright State spokesman declined to comment on that suit.
An attorney for Fendley on Thursday referred questions to another attorney. A message seeking comment was sent to Wright State spokesman.
