BNSF, Watchdogs Settle Coal Dust Lawsuit

SEATTLE (AP) – BNSF Railway and seven environmental groups in Washington and Oregon have settled a lawsuit saying that coal spilled from trains pollutes waterways in Washington state. BNSF admits no wrongdoing in the settlement finalized Friday. The plaintiffs had argued that coal spilled from open-topped train cars is polluting the Columbia River and other waterways in the Pacific Northwest.


Casselton Derailment Lawsuit Moved to Federal Court

Engineer Bryan Thompson had initially sued BNSF Railway for neglecting safety measures, but added Standard Steel later. Thompson was injured in the derailment, according to court documents. He alleges that a Standard Steel-made axle “failed suddenly and catastrophically,” causing the derailment, a complaint initially filed in Cass County District Court alleges.
