This comes after his Kenyan fiancee was denied a temporary resident visa in Canada
After suffering back to back strokes and brain haemorrhages, Patrick Kinsella requested to bring his fiancee to Canada to help him during a difficult time.
He says Ottawa rejected her visa – saying they don’t believe she will return to Kenya when the 180 days are up.
Kinsella believes the approval of temporary resident visas to Canada for citizens of non-visa countries are racist and bigoted.
“Canada does not have compassionate or emergency visas. This issue is way bigger then just me, because anyone like me who is a first generation immigrant, if you are seriously ill or an accident, there are no compassionate visas for your family members or loved ones to come and be with you, let alone attend your funeral.”
The situation has been tough on both him and his fiancee, “she is very distressed that she can’t be by my side while I go through this.”
He says he is trying to rectify the situation with this lawsuit.
“I am trying to get the regulation under the Immigration and Refugee Protect Act changed so they don’t violate the Canadian Human Rights Act and they no longer violate the Canadian Charter of Rights and Freedoms.”
According to Kinsella the pair does not plan to stay in Canada permanently, “It’s my intention that if my health gets better, to return to Kenya with her and retire there.”
He says he was receiving help from Waterloo MP Bardish Chagger during this process but that changed after he expressed his concerns with the immigration system.
The lawsuit was filed against Immigration Minister Ahmed Hussen, Chagger, and Prime Minister Justin Trudeau two weeks ago.
