HOUSTON — Two employees scolded by fryer grease after a floor collapsed at a Church’s Chicken in Livingston have filed a lawsuit against the franchise for $150 million, the women’s attorney announced this week.

Hugolina Guerrero de Garzon and Joselin Damian Gonzalez were two of three employee who were working in the restaurant’s kitchen August 1 when the floor collapsed around 6:30 p.m, according to Polk County Today.

“This is the worst case I have ever seen, with absolutely horrifying life-long injuries,” attorney Benny Agosto said.

Investigators said a deep fryer filled with scalding hot grease fell on top of Guerrero, Gonzalez and Erica Acevedo. They were endured life-threatening burns to more than 75 percent of their bodies, an attorney said.

Guerrero and Gonzalez suffered serious and permanent injuries and still hospitalized, an attorney said.

The suit is being filed against Triangle Capital Properties, LLC, CT Restaurants, L.P., and Store Master Funding VIII, LLC — the owners, operators, and managers of the Church’s Chicken, according to the announcement. The lawsuit alleges the companies failed to maintain a safe work environment for the workers, failed to properly inspect and maintain the premises, and failed to remedy a known dangerous condition.

Church’s Chicken management released a statement shortly after the incident saying, “Our thoughts and prayers are with the employees and their families who were impacted by an unfortunate incident.”

Management said Church’s Partners Foundation will provide some immediate support to the families.

Church’s Chicken added, “We are working closely with the franchisee who is working with the authorities to determine the cause of the accident.  At this time, we do not know when the restaurant will reopen.”
