Lawsuit in Teen’s Rope Swing Death Moved to SC

A lawsuit filed after the death of a teenager was moved this week from federal court in Florida to South Carolina.

Olivia Paige Grimes, 16, of Lakeland, Florida, died after falling from a rope swing last year at Young Life Camp in Pickens County. In July 2015, Grimes was on a pendulum swing with two others when she became unattached and fell about 120 feet.

The wrongful death lawsuit, first filed in December 2015 in Florida, sought damages in excess of $15,000.

In April 2015, Young Life added a triple-chair, high-altitude swing amusement ride called “Freebird” at Carolina Point, according to the lawsuit.

“Freebird is a gigantic version of a traditional playground swing set,” the complaint said. “Freebird holds three riders that each sit in a separate flexible strap seat which is suspended by cables connected to an elevated crossbar. Each rider wears a rappelling harness.”

When the accident happened, one employee was operating Freebird without assistance, which was an “egregious violation of safety standards and procedures for the swing,” according to the lawsuit.

The employee failed to secure the carabiner between Grimes harness and the metal chest bar, the lawsuit alleged. Grimes was sitting between two other riders. She fell out of the swing during the first forward swing and plummeted to her death.

The civil action names Young Life, Inc. and Adventure Experiences, Inc. as defendants. The suit alleges Adventure Experiences designed Freebird.

Neither attorneys for the plaintiff nor defendants could be reached by phone Wednesday.

“We continue to grieve with and for the family of Olivia Grimes over the tragic accident at Carolina Point last July,” Young Life Inc. said in a statement. “From the moment the accident occurred, our desire has been to respond appropriately by caring for those impacted and by maintaining the highest standards of safety for our camp guests. It is in this spirit that we are responding to the lawsuit brought by the Grimes family.”

A court-ordered mediation for the lawsuit has been scheduled for June 8.
