Low-Carb Diet Company Under Fire for Fudging Nutrition Data

Atkins Nutritionals Inc. fudges its nutrition data when it comes to “net carbs,” a new lawsuit alleges.

The Colorado-based carb-counting company touts its products as low-carb by “artificially subtracting” sugar alcohols from the definition of carbohydrates, the Brooklyn federal-court case alleges.

Dr. Robert Atkins, who died in 2003, was a major proponent of the low-carb diet.

The suit charges that marketing products like Nutty Fudge Brownie and Chocolate Peanut Butter Pretzel bars as being “net-carb” friendly is “misleading” and violates New York consumer-protection laws.

“Atkins made these false, misleading statements to deceive consumers into purchasing its products under the belief that they are extremely low in carbohydrates, when, in fact, they are not,” the suit claims.

Filed Friday, the suit seeks unspecified damages.
