St. Paul’s School Responds to Lawsuit Filed by Assault Victim’s Parents

Owen Labrie was convicted of sexual assault in a case that his lawyers said exposed a sordid tradition at the elite boarding school.

The girl’s parents, identified in the lawsuit as John and Jane Doe, allege in the lawsuit that school officials who were trusted with protecting their daughter failed to keep her safe by turning a blind eye to a tradition known as the Senior Salute.

The victim, referred to as J.D., was 14 when she enrolled in the school in 2013. Labrie was convicted of sexually assaulting her on a rooftop in May 2014. The lawsuit claims that school officials were aware of the sexual scoring game called Senior Salute but turned a blind eye to it.

The school responded that “the terms ‘score’ and ‘slay’ are vague … and refer to a wide range of conduct.” The school admitted that the term “scoring” appeared in a handbook written by students called “The Little Red Book.”

The school also admits that the rector’s wife received an email asking her to engage in the Senior Salute. The school called it a prank.

The lawsuit highlights evidence at the criminal trial, and the school admitted that in March 2014, Labrie sent an email to a friend that referred to “an eight-week exercise in debauchery.”

The lawsuit states that Labrie met the victim at 9:15 p.m. on the night of the assault, and he had a blanket and condom in his backpack.

The school responded by saying, “Only J.D. and Labrie know what happened between them on the evening of May 30, 2014.”

The school said it lacks knowledge or information sufficient to form a belief as to whether J.D. was sexually assaulted by Labrie.

The girl’s parents said St. Paul’s administrators, faculty, staff and board of trustees breached their duty of care to the victim by failing to protect her from sex abuse and failing to investigate the Senior Salute tradition that they said helped lead to their daughter’s assault.

Former Attorney General Michael Delaney is representing St. Paul’s School in the lawsuit. He declined to comment, citing pending litigation.
